We are not liable for any loss or damage arising from your failure to safeguard your account information.

4. Intellectual Property

The platform itself (including its design, interface, code, branding, and underlying AI models) remains the exclusive intellectual property of Naiomi Studio. You may not copy, modify, reverse-engineer, or distribute any part of the platform without our prior written permission.

Content you generate using Naiomi Studio is yours to use in your professional capacity as an educator. However, because AI-generated outputs may not be unique and may be produced for other users with similar inputs, we make no guarantee that generated content is exclusive to you, and we expressly disclaim any warranty of non-infringement with respect to AI-generated outputs.

5. AI-Generated Content: Disclaimer and User Responsibility

All content, lesson plans, instructional strategies, assessments, curriculum materials, and any other outputs generated by Naiomi Studio are produced by artificial intelligence and are provided solely as a draft starting point for your professional review and refinement. They do not constitute professional, legal, medical, or pedagogical advice.

You are solely and entirely responsible for reviewing, fact-checking, editing, and validating any content generated by this platform before sharing it with students, parents, colleagues, administrators, or any other third party. You assume all risks associated with your use of AI-generated outputs.

Naiomi Studio makes no representations or warranties, express or implied, regarding the accuracy, completeness, factual correctness, curriculum alignment, pedagogical appropriateness, grade-level suitability, or fitness for any particular purpose of any content generated by the platform. AI-generated content may contain errors, factual inaccuracies, biased perspectives, outdated information, or material that does not reflect current educational standards, research, or best practices.

By using this platform, you expressly acknowledge and agree that Naiomi Studio bears no responsibility or liability whatsoever for any incorrect, incomplete, inaccurate, misleading, or otherwise problematic content generated by the platform and subsequently shared or delivered as instruction to students or others. 7. Limitation of Liability

Naiomi Studio is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components.

To the fullest extent permitted by applicable law, Naiomi Studio and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the platform, including but not limited to loss of data, loss of revenue, reputational harm, or any outcomes resulting from the use of AI-generated content. Our total aggregate liability to you for any claims arising out of or related to these Terms shall not exceed the amounts paid by you, if any, to Naiomi Studio in the three months preceding the claim.

8. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms. You may also delete your account at any time from your account settings.
